Terms of service

The licence you are buying, what we promise, and what we do not.

Last updated 21 October 2026

These terms govern your use of the FitKliq desktop application, this website and the FitKliq licence service. They form an agreement between you (the gym or business buying a licence, "you") and AppSphere, Indore, Madhya Pradesh 452001, India ("FitKliq", "we"). By creating an account or activating a licence you accept them.

1. What you are buying

FitKliq is licensed, not sold. A paid licence gives you a non-exclusive, non-transferable right to run one copy of the FitKliq desktop application on one computer (Windows or Mac) for one year, for your own gym’s business use.

  • One licence = one computer at a time. Extra computers need extra licences.
  • Phones and tablets paired with a licensed desktop are included in your licence and are not counted separately.
  • Your licence year starts when we verify your payment, not when you place the order.
  • You may not share, resell, sublicense or rent your licence key, or use it for a gym other than the one it was issued to.
  • You may not copy, decompile or modify the application except where Indian law expressly permits it, and you may not work around the licence check.

2. Free trial

The trial lasts 7 days and is available once per account, once per computer and once per gym. It exists so you can evaluate FitKliq properly before paying. We may end or refuse a trial if it is being used to avoid paying.

3. Payment, verification and invoices

  • Prices are shown on /pricing and are exclusive of GST, which is added at checkout.
  • Payment is by UPI. You submit the 12-digit UTR reference, the payer UPI ID and a screenshot of the successful payment.
  • We verify each payment against our bank statement by hand - normally within 24 hours on working days. Your licence key is issued immediately but only activates on verification.
  • If the details do not match (wrong amount, UTR not found, a UTR already used for another order) we will tell you why and you can submit again.
  • A GST tax invoice is issued on verification and is available in your account. Invoices are issued to the billing details on your account at that moment, so keep them correct.
  • Submitting a payment reference that is not yours, or that belongs to someone else’s payment, is grounds for us to reject the order and suspend the account.

4. Renewal and expiry

  • We remind you 30 days, 7 days and 1 day before your licence expires.
  • Renewal is at the price in effect when you place the renewal order. Renewing early adds a full year to your existing end date, so you never lose paid days.
  • Pricing note: the reduced "additional computer" price applies only while your gym has another paid licence active at the time the order is created. Renewing your last remaining licence is priced as a first licence.
  • On expiry the application becomes read-only. You keep access to every record, you can still print and export, and your data remains in your own Google account. We do not lock, hide or delete your data.

5. Moving a licence to another computer

You can release a licence from a computer, from your FitKliq account or from within the app, and activate it elsewhere. You may do this twice per licence year yourself; beyond that, contact support and we will do it for you. A hardware change or operating-system reinstall that changes the computer’s identity is treated the same way, and support will not count it against your limit.

6. Your data and your responsibilities

  • Your gym’s records belong to you. They are created in your own Google account. We have no access to them and no copy of them. If you stop using FitKliq, your data stays where it is.
  • You are the Data Fiduciary for your members’ personal data under India’s Digital Personal Data Protection Act, 2023. That includes giving notice, obtaining consent, obtaining verifiable parental consent for members under 18, keeping the data secure, honouring member requests, and reporting breaches. FitKliq gives you tools for these; using them is your decision. See Your data & the DPDP Act.
  • You are responsible for the security of your Google account, your computers and your staff logins. Anyone with editor access to your gym’s spreadsheet effectively controls your gym’s backend - access and risks explains why, and what to do about it.
  • Backups of your Google account data are ultimately your responsibility, though the app’s export features make this straightforward.

7. What we provide, and what we don’t promise

  • We provide the application, updates during your licence term, and email support during business hours.
  • The application is designed to work offline. It needs occasional internet access for the licence check - a signed licence stays valid for 15 days offline before the app warns and then becomes read-only.
  • We do not guarantee that the software is free of defects, that it will suit a particular way of running a gym, or that Google’s services, UPI or your internet connection will be available.
  • Features marked "coming" on this website are plans, not commitments.

8. Suspension and termination

  • You may stop using FitKliq at any time and delete your account from your profile. Paid licences run to the end of their term; see refunds.
  • We may suspend or revoke a licence if payment is reversed or found to be fraudulent, if a key is shared or used beyond what was paid for, or if the service is used unlawfully. Where we revoke a licence for a refunded or reversed payment, we issue a credit note for it.
  • We will give you reasonable notice and a chance to fix the problem unless the issue is fraud or a legal requirement.

9. If FitKliq stops operating

If we cease operating the FitKliq licence service, your gym’s data remains in your own Google account and is readable without us. In addition, we have placed a signed perpetual-licence release in escrow: if fitkliq.com stops operating, that release is published so existing installations continue to work without a licence check. This is the extent of our commitment - we do not promise continued development, updates or support beyond that.

10. Liability

To the extent permitted by law, FitKliq is not liable for indirect or consequential loss, loss of profits, loss of business, or loss of data that was within your own control. Our total liability for any claim is limited to the licence fees you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, including liability for fraud.

11. Changes to these terms

We may update these terms. For material changes we will email account holders before they take effect, and the date at the top of this page will change. If you do not accept a change, you may stop using FitKliq; your current licence term is unaffected.

12. Governing law

These terms are governed by the laws of India. The courts at Indore, Madhya Pradesh have exclusive jurisdiction, except that either party may seek urgent interim relief elsewhere.
